The amendment to the 1945 Constitution resulted in a state institutional order that affected the authority of the MPR to promulgated regulatory MPR Decrees. Act Number 12 of 2011 lists MPR Decrees as a type of legislation, but in the explanation it limits it only to MPR Decrees that are declared still valid by MPR Decree Number I/MPR/2003. This has given rise to legal debate about the authority of the MPR to form regulatory MPR Decrees. This study analyzes the legal considerations of Decision Number 66/PUU-XXI/2023 which results in the implication that the MPR no longer has the authority to form regulatory Decrees. Therefore, MPR Decrees do not need to be included in the types and hierarchy of legislation. © 2025 by Jurnal Konstitusi.
